Homosexual community and the gay rights activists in India are probably going to party like never before today. Delhi High Court on Thursday, Jul 2 took a big step by decriminalizing the gay law. This means that the court has effectively repealed IPC Section 377 and that it no longer illegal to be adult and gay in the country.
The IPC Section 377 was an age old law that was introduced to India under the British rule and was was drafted in 1860 by Lord Macaulay. The law which is commonly known as the 'Anti sodomy Law' is devised to criminalize and in turn prohibit Homosexual associations.
Even as the so called progressive United States' California is re-thinking Proposition 8 that states, "Only marriage between a man and a woman is valid or recognized in California," India passed this historical judgement.
The move draws its significance from the fact that like women, the homosexuals and other sexual deviants are the underdogs of history and politics. For long these groups have fought for rights, the first step has been taken. But now the fate of the country's real stance on the development lies in the hands of its citizens.
While the Law, Home and Health Ministries still deliberated on the issue, Christian and Muslim communities and religious leaders slammed the idea. Apart from religious opposition, a commoner still struggles to break free from our taboos of natural sex that has been thrusted upon the country due to limited outlooks owing to a false construction of a so called 'modest culture'.
Church shows cross at court!Even when art represents the community, it has only been for comic relief or to instigate disgust. Like Dostana or Kal Ho Na ho the portray clicked only because of its comic twist. This carries on to our lives, we pull each others legs with the 'label' or swear at others, but how often do we take the community seriously or accept it as natural?
So will India embrace the groundbreaking move towards acceptance or will gay association become one in the troublesome lists like dowry deaths, love marriages, inter caste marriages, child labor, and crime against women, is something we will have to wait and watch.
