BMW case: SC upholds RK Anand's conviction

New Delhi, Jul 29: The Supreme Court of India on Wednesday, Jul 29 upheld the conviction of senior advocate R K Anand for contempt of court in the BMW hit-and-run case.

While, the apex court found special public prosecutor I U Khan"s conduct inappropriate but set aside his conviction and cleared him of contempt charges.

The bench comprising of three Justices B N Agarwal, G S Singhvi and Aftab Alam, pronounced the verdict on Wednesday, Jul 27 after watching original footage of the sting operation by the TV channel.

Supreme Court also observed that a sting operation by done by a TV news channel, that exposed an alleged link between the witness and the defence lawyer, was in public interest and cannot be termed as a case of trial by media.

Earlier, on Aug 21, 2008, the Delhi High Court had also convicted senior Anand and Khan in the BMW expose case after a sting operation by a television channel alleged collusion between the prosecution and the defence.

The HC also debarred them from practicing in Delhi for four months and also imposed a fine of Rs 2,000 each for obstructing the course of justice by trying to influence the witness.
