Allahabad, Mar 25: Allahabad High Court on Wednesday, Mar 25 dismissed the petition seeking stay on Varun Gandhi's arrest and quashing of an FIR filed against him for his alleged 'hate speech' against Muslim community in Pilbhit.
In its order, a division bench comprising justices Imtiyaz Murtaza and S C Nigam said, 'the petition stands dismissed'.
The court observed that there was no need for a stay since anticipatory bail had already been granted by the Delhi High Court.
Varun Gandhi had moved to the Allahabad High Court challenging the criminal case lodged against him as directed by the Election Commission.In his petition, 29-year-old Varun had challenged the FIR filed on March 17 at Barkheda Police Station under Sections 153 A (promoting enmity between different groups on ground of religion) and 188 (disobedience to order duly promulgated by a public servant) of the Indian Penal Code and Section 125 of the Representation of the People Act.
Now the BJP leader Varun Gandhi's lawyers are all set to move to Supreme Court after Allahabad High Court dismissed his petition.
