Top Cop told to execute NBW against businessman

Chennai, Aug 21 (UNI) The Madras High Court has directed the Chennai City Police Commissioner to nominate an Assistant Commissioner of Police to execute a Non-Bailable Warrant (NBW) issued by a Magistrate in Saidapet, against businessman Jhunjhunwala, who had allegedly cheated and misappropriated Rs 18 crore.

Justice K N Basha gave the direction while passing orders on a criminal original petition from the affected person G Moorthy, who prayed for a direction to the Inspector of Police, Central Crime Branch (CCB), to execute the NBW issued on March 26, 2008.

According to petitioner, Jhunjhunwala was arrested in Mumbai on March 17 last and enlarged on transit bail by Sessions Court there on condition that he appear before the XI Metropolitan Magistrate in Saidapet here on March 26. On the same day, the Magistrate issued the NBW.

Meanwhile, Mr Jhunjhunwala preferred two anticipatory Bail applications and they were dismissed by the High Court. Yet he did not appear before the Magistrate, petitioner contended.

''To prevent the abuse of process of the court, this court is constrained to give the direction'', the judge said.
