HC issues notices to CBI on Nandas' bail plea

New Delhi, Apr 10 (UNI) The Delhi High Court today issued notices to the CBI on the application of arms dealer Suresh Nanda, his son Sanjeev and their chartered accountant Bipin Shah, seeking bail in the Barak Missile deal case.

Justice Rekha Sharma, after hearing the application of the three, issued the notices to the CBI to file their reply by April 23 and 24.

The lawyer appearing for Suresh Nanda told the Court that the accused have been booked under offences which are bailable under the Indian Penal Code(IPC).

They were booked on charges of hatching a conspiracy and there is no evidence against them of committing any offence.

They have been charged under section 120(b)(criminal conspiracy) of the IPC.

The petition said the transcripts of taped telephonic conversation among the accused did not support the allegations levelled by the agency.

The CBI has transcripts of 94 calls exchanged between the Nandas, Deputy Director of Income Tax Ashutosh Verma and Shah between February 7 and March 8.

The four accused had gathered in Mumbai in a hotel on March 9, this year to negotiate the bribe amount to be paid to Verma, where they were arrested by the CBI.

Earlier, Additional Sessions Judge I K Kochar had rejected the bail application of Suresh and others on the ground that investigation was at an initial stage.

The Court had also refused to release certain incriminating documents seized by the CBI from the Nandas as it could hamper the investigation.

The Nandas were accused of receiving kickbacks to the tune of Rs 400 crore in the Barak Missile Defence deal as they allegedly tried to manipulate their IT returns with help of Verma.

Sanjeev is also a prime accused in the BMW-hit and run case for mowing down six people with his car in 1999.
