Manyata's divorce to Mehraj 'false'

Mumbai, Mar 18: In a setback to Bollywood actor Sanjay Dutt and his wife Manyata, the Metropolitan court today termed the divorce between Manyata and her first husband Mehraj Sheikh ''false'' with no substantial evidence to back it.

The court stated in its order that the claim of Manyata that she and her first husband had ''divorced'' earlier is false because there is no substantial evidence to this effect. Manyata had recently married Dutt in Goa. Later, her first husband, who is currently languishing in jail in an extortion case, had filed a case against them. The court had already issued summons to Dutt and Manyata to appear before the court on April 1 to file their say, pertaining to the divorce and their marriage. The court also observed that as per Muslim Marriage Act of 1939, the Kazi did not have power to dissolve a marriage, for which the husband's consent is a must.

However, Mehraj had already told the court that he had not accepted the notice issued by the Kazi and not given any consent for divorce to Manyata.

Mehraj had challenged the marriage of Manyata and Dutt, saying they had violated the Muslim marriage act norms, according to which, a woman cannot remarry any other person without a formal divorce.
