HC dismisses the plea of Apollo doctors

New Delhi, Feb 15 (UNI) Delhi High Court today dismissed the plea of Five doctors and some other staff of Delhi's Apollo hospital who had sought that their names be removed from the list of accused in the Rahul Mahajan drug abuse case.

A bench headed by Chief Justice M K Sharma dismissed the petition and told the doctors to approach the sessions court. Five doctors and six other staff members of the hospital had asked the court to quash charges against them of tampering with evidence and misleading the probe in the Rahul Mahajan drug abuse case.

Justice Reva Khetrapal of Delhi High Court had earlier stayed the lower court proceedings against the doctors and had asked the Additional Chief Metropolitan Magistrate not to proceed with the case till further orders.

Appearing for the doctors, senior counsel Harish Salve submitted that the subordinate court did not have the jurisdiction to prosecute the doctors on the "false charges" framed by police.

The police had filed the complaint without proper investigation, argued Mr Salve, seeking quashing of the chargesheet filed in January this year.

Rahul Mahajan, son of late BJP leader Pramod Mahajan, was admitted to the hospital on June 1 last year following an alleged drug overdose. It was alleged that the doctors had misled the investigators and fabricated the report about his treatment sought by police.

The Court today dismissed the petition and directed the doctors to approach the lower court in this regard.
