Produce case diaries in murder, sexual exploitation case, J

Srinagar, Dec 27 (UNI) A local court has directed the Jammu and Kashmir police to submit case diaries in connection with the murder of a girl, who had named some people including a woman, allegedly involved in the sexual exploitation of innocent girls.

The order to police by the Chief Judicial Magistrate (CJM) came on a petition filed by the Forum Against Social Evils (FASE).

The SHO of police station, Soura, has been directed by the court to submit the status report of the case.

FASE alleged that the girl Aaliya, a resident of Soura, was murdered after sexual assault when she named some people including a woman Sahiba alias Gypsy alias Abida of Lal Bazar, who were forcing innocent girls in to flesh trade.

In the petition, FASE had alleged that Aaliya was done to death on the direction of these people.

During the argument the counsel for the petitioner, Bashir Siddique, said Aaliya had revealed to the FASE members how Sahiba mentally and physically assaulted her while keeping her in illegal confinement.

The counsel said the victim was subjected to sever physical and mental torture by the accused during her 25 days illegal confinement.

The victim was also given sedative drugs, he informed the court.

He said, to shield the accused, the case was not being investigated in ''real perspective'' as there has been no substantial progress till date.

The matter was serious in its nature as it involves the social fabric of our society, the petitioners counsel said, adding that there has been no substantial progress in the case.

He said though police has assured the petitioner of exposing the culprits but for speedy justice the case should be investigated by a team of high-rank police officials.

The counsel said there has been no formal arrest in the case which needs to be considered.

He informed the court said the victim had expressed apprehensions about her safety in her statement to FASE which should be taken as a dying declaration.

It can be taken as a valuable piece of evidence and the accused can be convicted on basis of the dying declaration, the counsel pleaded.

Though police has arrested Sahiba but she was booked under Prevention of Immoral Trafficking Acts (PITA), illegal confinement and NDPS Act, he said and demanded registration of murder case taking into consideration the nature of the case.
