T P Verma's application in Ayodhya demolition case rejected

Lucknow, Oct 26 (UNI) Lucknow Bench of the Allahabad High Court today rejected an application seeking appointment of a HC retired judge as 'Nyay Mitra' (amicus curie) to represent Ram Lala in the Ayodhya demolition case.

The order was passed by a special full bench comprising Justices Sayyed Rafat Alam, D V Sharma and O P Srivastava on an application filed by Dr T P Verma.

Dr Verma had prayed for permission to retire as amicus cury and to appoint Justice Kamal Nath, a HC retired judge, in his place.

The application stated the applicant was indisposed since last year and therefore, unable to instruct the counsel from Varanasi, where he was residing.

Application of the 'Nyay Mitra' had been contested by Nirmohi Akahara and Sunni Central Waqf Board by filing objections on the ground that arguments had already been commenced in the case and there was nothing in support to show that the applicant was actually ailing and incapable of instructing to the counsels of plaintiffs.

The applicant had not disclosed his ailment as well.

In view of the above, the Bench observed ''the desire of Dr Verma is not genuine and not based on adequate reasons. Therefore, once he was appointed with his consent, he cannot be granted permission sought for in his application.'' UNI
