Gauhati H C directs gov to allot 3% job reservation to disabled

Guwahati, Mar 15 (UNI) A Division Bench of Gauhati High Court has directed the Asom government to adhere to the 3 per cent reservation for jobs for disabled persons as stipulated in the Persons with Disabilities(PD) Act, 1995.

In a case filed jointly by Arman Ali and Prasanna Pincha, the Division Bench of Justices A H Saikia and H N Sharma of the High Court Court has directed that the statutory provision of 3 per cent reservation for the disabled must be adhered to.

Setting aside the earlier interim order staying the holding of examination by the Asom Public Service Commission (APSC), the court directed the Government of Assam and the APSC to make a revised advertisement incorporating the mandatory 3 per cent reservation for persons with disabilities as per the PD Act.

Though the PD Act, 1995, stipulates that at least 3 per cent of all vacancies in government posts should be reserved for the disabled. Despite this, in its recent advertisement for recruitment to various services/posts (including the Assam Civil Service), the APSC made reservations for all categories such as OBC, MOBC, SC, ST(P) and SC(H), but completely ignored the rights of persons with disabilities.

The Court made it very clear that considering the importance and urgency of the matter the entire process is to be completed in 4 weeks.
