Sujata Nikalje withdraws petition

Mumbai, Mar 6 (UNI) Sujata Nikalje, wife of underworld don Chhota Rajan, today withdrew her petition, challenging the application of MCOCA against her in a case of extortion in Chembur area, allegedly with the help of Rajan, as the court was inclined to reject the petition.

Senior Counsel Sushil Kumar withdrew the petition as a division bench of Justice Ranjana Desai and Justice Anoop Mohata indicated the court is inclined to reject the petition. Sujata has been booked under MCOCA in a case of extortion of Rs 10 lakh from a builder in Chembur.

The court also refused to grant bail to her as interim relief.

Sujata challenged the application of MCOCA, saying there are no prior chargesheets filed against her and hence a precondition of MCOCA is not being fulfilled in her case. The stringent MCOCA Act requires at least two chargesheets and must have been filed against the accused prior to the application of the act.

But the court accepted the defence adopted by the public prosecutor Satish Borulkar that the requirement is with respect to the Organised crime syndicate and not an individual accused.
