him bail

New Delhi, Mar 5 (UNI) The Delhi High Court today granted bail to Congress Parliamentarian Sajjan Kumar in a 1984 riots case after admitting the appeal of the CBI.

A division bench headed by Justice Manmohan Sarin said Kumar and seven others were granted bail on furnishing a bond of Rs 15,000 each.

The trial court had acquitted Kumar and others in the riots case due to lack of evidence in December 2002.

The CBI in its appeal said the acquittal of Kumar, the outer Delhi Lok Sabha member, by the subordinate court was a ''miscarriage of justice''.

The trial court did not appreciate the deposition of prosecution witnesses during the proceedings, said the CBI petition.

The court did not consider the statement of a witness, who deposed before the court that ''Had Sajjan Kumar not been there, the incident would not have occured''.

The subordinate court had observed in the order that the ёevidence in respect to Sajjan Kumar was poor.Ғ The court said the case would be heard on day-to-day basis.

The Delhi Police which probed into the riots which claimed lives of more than 2,000 people after the assassination of Prime Minister Indira Gandhi could not justify its case in the trial court.
