MCD announces new policy for regularising buildings

New Delhi, Dec 26 (UNI) The Municipal Corporation of Delhi (MCD) has delineated a new policy for regularisation of building plans following the September 22 notification of revised building bye-laws by the Union Urban Development Ministry.

As per the new policy, devised by the Building (HQ) of Engineering Department of the MCD, owners are required to submit two copies of building plans of the existing building, prepared in accordance with clause 6.2 of the Building Bye-laws, duly signed by the architect and the owner.

These plans shall be accompanied with the ownership document, three sets of photographs taken from different angles, structural safety certificate of a structural engineer, fee and levy as per November 20 notification of the Delhi Development Authority. The fee is to be calculated by the Architect/Owner on a self-assessment basis.

The Architect, in addition, will submit a certificate that building conforms to norms as laid down in Ministry notification and the portion of building to be regularised is shown in red colour and the portion falling beyond the norms, to be demolished by the owner, is to be shown in yellow colour.

An affidavit is to be obtained from the owner, who will undertake that any portion of the building, if found beyond the norms, shall be demolished by him within two months from the date of regularisation, failing which the MCD will be free to take demolition action without any notice.

As per the new policy, test checks to the tune of ten per cent of the cases regularised in a month in each zone, as decided by the Dy Commissioner, shall be conducted at random to verify the correctness of the affidavit filed by the owner and the certificate of the Architect.

To bring transparency in the system, E E (Bldg.) of the zone will prepare a monthly statement of the properties regularised and charges collected and submit the same to Dy Commissioner, who will decide the properties for checking by the staff of Building Department.
