New Delhi, May 22 (UNI) Former Rajya Sabha member D P Yadav was today given eight weeks time to tell a sessions court the whereabouts of his daughter Bharti Yadav, a key witness in the Nitish Katara murder case.
Ms Yadav, summoned to testify as a prosecution witness, was believed to have been working as a staff nurse in England, but her father at Ghaziabad has been unable to produce her before the court for over a year despite several non-bailable warrants issued against her.
His son, Vikas Yadav, a key accused in the murder, has been in jail since 2002, except for a few months when he was out on bail.
Appearing before the Additional Sessions Judge Ravinder Kaur, D P Yadav submitted that at present he is not aware of Bharti's whereabouts. However, he has sought one-and-a-half-month's time for locating her address. The court has accepted his request and gave eight-week time to furnish the report.
Meanwhile, a fresh NBW has been issued against Bharti on her 32, Swallon Court, Carlton Gate, London and 60, Fredrick Road, Leicester address through the Ministry of Home Affairs, Ms Kaur said in her order.
A notice has also been issued to the Ministry of External Affairs for July 17, to make all possible efforts to trace out the present address of Bharti in the UK.
Vikas Yadav and Vishal Yadav, the brother and cousin of Bharti respectively, are facing trial in the case for allegedly kidnapping and murdering Nitish Katara on the intervening night of February 16-17, 2002, from Ghaziabad where Nitish had gone to attend a marriage party.
Bharti, a key witness in the case is reportedly working as a staff nurse in London. She did not come to depose in the case citing some pleas. She was one of the last persons to have met Nitish.
The prosecution believes that the recording of her statement in the court would reveal the motive behind the crime. Bharti allegedly had an affair with Nitish, son of a senior Indian Administrative Service (IAS) officer.
The prosecution has alleged that the accused had killed Nitish because they did not like his relationship with Bharti.
Vikas had masterminded the killing of Nitish after learning about his affair with his sister, prosecution alleged .
Vikas and Vishal were booked under Sections 302 (Murder), 364 (Kidnapping) and 201 (Destruction of Evidence) and 34 (Common Intention to Commit a Crime) of the Indian Penal Code (IPC).
