BSP MP's petition seeking quashing of FIR dismissed

Allahabad, May 22 (UNI) The Allahabad High Court today dismissed the petition filed by BSP MP from Azamgarh Rama Kant Yadav for the quashing of FIR and stay of arrest in a criminal case.

The order was passed by a division bench comprising Justices Imtiyaz Murtaza and Amar Saran.

According to a report, Mr Yadav alongwith 200-250 armed supporters had collected at Pawai crossing on April 5, 2006 and obstructed traffic, causing great inconvenience to the general public.

Next day, an FIR was lodged under section 143/341 IPC against the MP and others at Pawai police station, Azamgarh.

However, Mr Yadav pleaded he had been falsely implicated due to political rivalry, because he belonged to BSP and had defeated the ruling Samajwadi Party candidate.

The court held such a plea could always be raised by a politician, who belonged to an opposite party, whenever he was involved in an offence.

The bench declined to interfere with the FIR as cognisable offence was made out against the petitioner.
