Defence counsel urges not to consider police chargesheet

Ahmedabad, Apr 29 (UNI) Sabarmati Express carnage accused Hussein Abdulsattar Durvesh's cousel pleaded before the two-member Nanavati-Shah Commission, probing the carnage and post-Godhra riots, not to consider the police chargesheet before the POTA court.

Advocate Mahesh Bhatt, who had filed an application before the Commission on behalf of the accused, asked them not to consider the chargesheet filed against the accused under POTA as it only stated what the investigating agency was probing.

Mr Bhatt further argued that if the chargesheet is taken into cosideration, the case in the POTA court would suffer. It should, therefore, consider the chargesheet against Durvesh who is out on bail.

He urged the Commission to discard the chargesheets from the evidence and return it to the Investigating Officer.

The matter will come up for hearing on June 5.
