BJP opposes clean chit to Chawla

New Delhi, Apr 7 (UNI) The Bharatiya Janata Party tonight dubbed as ''totally unconstitutional'' the Government's decision to give a clean chit to Election Commissioner Navin Chawla, charged with receiving funds from Congress MPs' local area development fund for charities close to him.

Article 324 (5) of the Constitution clearly provides for hearing in the matter by the Chief Election Commissioner (CEC) and not by the Government, party spokesman Prakash Javadekar said, reacting to reports that Attorney General Milon Banerjee had exonerated Mr Chawla of the charge.

The Attorney General came into picture after the President sought the Government's opinion on a complaint by over 200 Opposition MPs, questioning Mr Chawla's impartiality as EC. The AG was today said to have given a clean chit to the EC in his report to the PM.

Mr Javadekar said the issue related not just ''to the legality of past conduct and past loyalty, but also of present conduct'' with relation to Mr Chawla.

''The BJP will oppose if this unconstitutional act is perpetrated as the impartiality of the Election Commission is at stake,'' he said.
